Bexar County Criminal Defense

Why the file is kept in tiers

The factual timeline and the attorney work product do not belong in the same pile, so the matter folder keeps them physically separate, which is what lets you defend the handling of the file.

Not every document sits at the same level of protection

A criminal matter holds two very different kinds of paper that a careless file treats as one. There is the factual record, the discovery the State produced, the body-cam video, the 911 audio, the offense reports, the things that exist in the world whether you ever touched them or not. And there is the work product, the attorney’s own thinking: the investigative notes, the draft motions, the strategy, the privileged communications with the client. The law treats these two differently, and a file that piles them into one undifferentiated drawer treats as ordinary discovery the very material the privilege is supposed to shield.

So the matter folder the Case Board lays down does not pile them together. The folder tree is built so the privileged casework and the factual evidence each have their own place. The raw discovery the Evidence Orchestrator reads lands in the evidence subfolder. The work product and client communications live in the casework subfolders. They are separated by structure, in your own Google Drive, from the first hour the matter opens, before there is anything in either one to separate.

The matter is the container, the sender is only a label

There is a second rule under the first one, and it is what keeps the tiers from blurring as the matter grows. The matter is always the container, and the person who sent a given document is only metadata, a label inside the drawer. Different people emailing about one case never spawn separate top-level folders. The prosecutor, the investigator, the client, the coordinator: their messages file into the one matter, sorted by what the document is, not scattered into a folder per correspondent.

This matters because that is exactly how a file goes wrong over months. Documents start landing wherever the sender’s name suggested, the discovery ends up next to the work product because they came from the same thread, and by trial week no one can say cleanly what is privileged and what is not. Keeping the matter as the container and the sender as a label means the factual lane stays factual and the work-product lane stays work product, no matter how many hands touched the case. The structure does the discipline so a busy defender does not have to do it by hand on every email.

A file you can defend the handling of

The payoff comes the day a judge or the State asks what is in the file and how it was kept. With an undifferentiated pile, the honest answer is a shrug and a scramble. With a tiered file, the answer is a structure: here is the factual record the State produced, kept in the evidence lane; here is the attorney work product, kept separate, where it has been since the matter opened. You can show where the line is because the line was built in from the start, not reconstructed under pressure.

This is also what lets the Evidence Orchestrator and the Issue Spotter work without crossing the line. The Orchestrator reads from the evidence lane, the factual record, and writes its indexed findings back where the facts live. The Issue Spotter drafts work product into the casework lane. Every AI action is logged to an audit table, so there is a record of what was read and when. The separation is not just tidy. It is the thing that keeps the machine’s reading of the facts from contaminating the privilege over the strategy.

The protection is structural, and it is yours

The most important word here is physical. The tiers are not a setting you can forget to apply or a tag that falls off a document. They are how the folders are built, in your own Drive, on the file you control. The factual timeline and the work product are kept apart by where they sit, which means the protection holds even on the busy weeks when no one is watching the back wall, and even as a matter runs for a year and a hundred documents land in it.

Gideon promised a prepared defense, and a prepared defense is one whose file holds up. A solo defender carries the whole question of privilege alone, with no records department and no firm-wide system watching the structure. The tiered folder is that system, built once when the matter opens, keeping the discovery and the strategy in separate lanes so that the appointed client’s file is as defensible as any retained client’s. The structure protects the file, and the file is what protects the defense.
